Divorce Mediation

In Divorce Mediation, a neutral Mediator conducts three way negotiation of the Divorce Agreement with the spouses. As with Collaborative Divorce, in Divorce Mediation the couple retains control over decision making. Unlike Collaborative Divorce, in Mediation spouses advocate for themselves rather than having attorneys with them.

Although Divorce Coaches usually do not function as part of a team in Divorce Mediation as they do in Collaborative Divorce, there is a valuable role for Coaches in Mediation. A Coach works with the couple jointly or with the spouses individually to manage the emotional component of the process, keep negotiation on track, and assist in developing a parenting plan which best meets the needs of the children.

A Coach can be instrumental in helping the couple move past any impasse blocking the way to successful completion of the Mediation.

The final Agreement is drawn up by the Mediator, reviewed by the spouses’ review counsel and submitted to the court for approval to finalize the divorce.
