of their divorce without
going to court.
Collaborative
Divorce begins with a
written agreement to focus
upon the needs of the
family as they move from
a shared life in a single
household to separate
lives and to commit to
resolving issues and disputes
out of court. Specialists
address the legal, financial
and emotional components
of divorce rather than
relying on an attorney
to do everything.
Husband
and wife each engage an
attorney to address legal
issues in a series of
four way discussions with
the husband, wife and
the two attorneys. A neutral
financial specialist assesses
the couple’s
financial situation, assists
the couple to make informed
financial decisions and
counsels them on how to
best implement their decisions.
They work together to
insure the financial settlement
meets individual interests
as well as interests of
the family as a whole.
Each
spouse engages a Divorce
Coach to prevent emotional
issues and past history
from impeding the divorce
process and the family’s
transition to a new
chapter.
Coaches meet individually
with the spouses and
in four way meetings
with
both spouses and both
Coaches. The Coaches
assist the spouses to
articulate their interests,
feelings and concerns,
to re-tool their relationship
from spouses to former
spouses and to facilitate
the creation of a parenting
plan which best meets
the needs of the children.
A child specialist is
brought in if needed
to address any critical
developmental, emotional
or adjustment needs
of
the children.
The
attorneys draw up the
final Agreement which
is submitted to the court
for approval to finalize
the divorce.
